Foreword (In Memoriam)

I am pleased to have been invited to contribute this foreword to a work that represents an important attempt to map the contours of the subject of development law by someone who combines the discipline of an academic with the insight of a practitioner actively engaged in the field. Although there is much in this area that is controversial, Rumu Sarkar’s work manages to avoid the pitfalls of ideology that seem so often to beset writings on this subject. The work begins with what the author has termed a “fin de siècle analysis” of trends affecting the milieu of development and the evolution of legal principles involved in this movement. Indeed, this stock-taking element is a constant feature of the book, being further represented by the author’s notion of the “Janus Law Principle,” emphasizing “the importance of looking backward into the past of a developing country as well as ahead into the futur
